WINNI JAMES DESIGN TERMS & CONDITIONS
Winni James Design agrees to provide the services requested by the Client in exchange for the amount agreed upon at the time of acceptance.
Services can include, but not limited to:
Book Cover Design
Branding Design
Merchandise Design
Social Media Graphic Design
PAYMENT/DEPOSIT A deposit of 30% is required upon hire. In the event the job is not completed in the time agreed and the Client chooses to no longer move forward with the project, the deposit will be reimbursed in full. The responsibility for the issue must lie on Winni James Design.
The deposit will not be refundable if the Client chooses not to use the design if completed in full, the Client is not able to work with Winni James Design in the time that was agreed upon initial hire, or the Client is no longer wishing to move forward with the project and work has already begun.
Remaining payment amount is due before product is released. Payment is addressed through a PayPal invoice.
REVISIONS Two full completed drafts are included in the initial price.
If after the second completed draft is sent to the Client and they request a complete restart or multiple revisions that are not simple tasks, an additional $20.00 dollars per request will be added to the final invoice.
DELIVERY Completed file/s will be delivered to a shared Google drive. Book cover files will be sent in .PDF format. Graphic files will be sent in .PNG format.
TIMELINE Projects will be accepted on a monthly basis. No exact timeline will be given aside from it being completed within the month agreed upon. If additional conversations are had regarding the timeline, it will be agreed upon by both Winni James Design and the Client.
COPYRIGHT & USAGE Winni James Design retains copyright of all original artwork until full payment is received.
Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the design for the agreed purposes.
Winni James Design retains the right to display the work in portfolios and for self-promotion.
ASSETS & AI USAGE All assets used in the project completed by Winni James Design is completed with asset sites that are paid for by Winni James Design and in which Winni James Design holds licensing credits.
Winni James Design does not use any assets that have been marked as AI. In the event an AI generated asset is used, Winni James Design will address the situation immediately. Which can result in changing the asset and/or reworking the design as needed.
RUSH FEE In the event a Client requests a job be done outside the one month request, as listed above, a Rush Fee of $20.00 dollars will be added to the final invoice.
CANCELLATION POLICY If the Client cancels the project after work begins, the deposit is forfeited.
CONFIDENTIALITY Both parties agree to keep confidential any proprietary information shared during the project.
LIMITATION OF LIABILITY Winni James Design is not liable for any damages resulting from the use or misuse of the final designs, or for printing errors caused by third-party vendors. It is the responsibility of the Client to proof the project and advise if any details need to be addressed prior to printing.
AGREEMENT By accepting and/or paying the deposit, the Client agrees to these terms and conditions.
